Shown below are the current MyAuto Innovations Membership and Service Terms and Conditions. Please refer to your membership kit for specific terms and conditions applicable to your membership. AGREEMENT made between Consumer Innovations an Arizona corporation with offices at PO Box 45439, Phoenix, AZ 85064, providing a service called MyAuto Innovations, called "MYAUTO," and the person specified on the accompanying MYAUTO membership card.

WITNESSETH:

  1. SERVICE:
    1. The service which Consumer Innovations shall provide to you during the term of the membership shall include
      1. Up to 5 (five) emergency road assistance calls per year. Additional assistance is available, however, the member will be responsible for any charges incurred.
      2. trip routing, and
      3. An array of Service Center discounts
    2. Consumer Innovations shall provide to you on a timely basis necessary information to utilize the services, which you have ordered from Consumer Innovations. Subject to the cancellation and refund policies of the providers of our MYAUTO services ("Vendors"), upon receipt of your request to cancel an order for services you placed through MYAUTO, Consumer Innovations shall use its reasonable best efforts to obtain from the Vendor a refund of any amount you paid for such order, less any applicable cancellation fees or penalties.
    3. Consumer Innovations reserves the right to change the terms and conditions of this Agreement and to modify or eliminate any services or benefits or any participating merchants, benefit providers, vendors, or suppliers at any time. Consumer Innovations may cancel this Agreement upon written notice, and refund of the current term's membership fee.
  2. WHO MAY USE The membership can be used by the member only. You will be responsible for all use of your membership number.
  3. MEMBERSHIP FEE The fee will be billed to your designated credit card account or credit line under the terms described below.
  4. RENEWALS Unless you notify Consumer Innovations that you do not wish to renew your membership, Consumer Innovations will automatically renew your membership at the end of each term and bill the then-current membership fee to the designated credit card. Consumer Innovations will notify you at least 45 days in advance of any charge to your card.
  5. RIGHT TO CANCEL MEMBERSHIP You have the right to terminate this Agreement at any time. You may cancel this Agreement by calling 1-800-854-8098 or writing to MyAuto Innovations, P.O. Box 45439 Phoenix, AZ 85064. If you cancel this Agreement during your trial period, you will not owe any membership fee. If you discontinue your membership at any time after the trial period, you can receive a refund of the unused portion of the current year's membership fee subject to a small cancellation fee.
  6. LIABILITY (a) Consumer Innovations shall have no liability in regard to any services provided or to be provided, by any Vendor. You agree that any claim with regard to services shall be made against the Vendor of such services and not Consumer Innovations. Consumer Innovations sole obligation hereunder shall be to forward to the Vendor all payments for services ordered, and to forward to you all necessary documents. (b) Consumer Innovations and its subsidiaries, and affiliates assume no responsibility nor liability in connection with the service of any train, vessel, carriage, aircraft, motor vehicle, or other conveyance which may be used, either wholly or in part, in connection with the services ordered, nor will any of them be responsible for any act, error, or omission, or for any injury, loss, accident, delay, or through the neglect of any person engaged in carrying out the purpose for which tickets or coupons are issued. Any information provided by Consumer Innovations to you is subject to change without notice. All services ordered are subject to the availability of such services from the Vendor.
  7. GOVERNING LAW; ARBITRATION This Agreement, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the State of Arizona. Any dispute arising between you and MYAUTO will be submitted to arbitration in the sate of Arizona in accordance with the rules of the American Arbitration Association then in effect. Nothing shall deprive you of the benefits of your state's consumer protection laws.
  8. CONFIDENTIALITY All information and software provided through MYAUTO is and shall remain the sole and exclusive property of Consumer Innovations. You shall not publish, broadcast, retransmit or otherwise reproduce the information or software in any medium. Any violation of this restriction is an infringement of copyright or proprietary rights in the information and software.

Service Terms and Conditions:

  1. Towing - Provided for up to 15 miles at no charge to member. Additional mileage is the responsibility of the member and will be negotiated prior to sending out service (extrication is included).
  2. Emergency Road Service - Any available contracted road service that is needed to get your vehicle running (i.e. hose replacement or tightening of cables or belts etc.)
  3. Essential Fluids or Supplies Delivery - Including gasoline, water, oil, or any supplies necessary to send a member's car on its way (member responsible for actual cost of fluid or supplies requested).
  4. Flat Tire Changes or Repairs - Includes changing a flat tire with your good spare or plugging a punctured tire.
  5. Emergency Battery Service - Includes tightening or cleaning of cables, jumpstarts, minor adjustments to alternator etc.
  6. Lockout Services - Lost keys, broken keys, or accidentally locked out of your vehicle, we will send a locksmith.
  7. Extrication - Provided for vehicles if vehicle is no more than 15 feet from a paved or other regularly maintained road or highway.
  8. Accident/Collision Assistance - Towing provided up to 15 miles for covered members involved in an accident or collision.

Coverage:
Is extended to member, legal spouse and dependent children living at home and for vehicles registered in their names only. You are covered for up to 5 services per contract period and 1 service per 72-hours.

The following items are not included as part of the emergency roadside assistance benefit: Cost of parts, replacement keys, fluids, lubricants, or fuel, cost of installation of products, material and additional labor related to towing. Disconnecting or reconnecting drive shaft. Non-emergency towing or other non-emergency service. Trucks over one-ton capacity, taxicabs, limousines or other commercial vehicles. Towing from a service station, garage or repair shop. Towing by other than a licensed service station or garage; vehicle storage charges; a second tow. Service on a vehicle that is not in a safe condition to be towed. Towing or service on roads not regularly maintained, such as sand beaches, open fields, forests and areas designated as not passable due to construction, etc. Mounting or removing of snow tires or chains. Towing at the direction of a law enforcement officer relating to traffic obstruction, impoundment, abandonment, illegal parking, or other violations of law. Repeated service calls for a covered vehicle in need of routine maintenance or repair. In the event of damage due to fire, flood or vandalism: Cost related to physical damage due to fire, flood, or vandalism are normally covered under your vehicle insurance. Nation Safe Drivers will assist you when you call our toll-free number, but you will have to pay for these services and submit your bill to your insurance company or agent as a part of the insurance claim.

SERVICE PROVIDER NETWORK
Nation Safe Drivers operates through a network of contracted service providers who have arrangements with our dispatch to perform road and towing service for Nation Safe Drivers members. As independent contractors, they have exclusive control over their own equipment and personnel. Nation Safe Drivers is not responsible for their acts or omissions.

Theft Reward - In the event your car is stolen anyone that provides information to law enforcement agencies that leads to the arrest and conviction of the perpetrator is eligible to apply for a $500 reward. Members or members family are not eligible to eligible for a reward.

Hit and Run - In the event of a hit and run involving a car registered to a Nation Safe Drivers member anyone providing information to law enforcement agencies that leads to the arrest and conviction of the perpetrator is eligible to apply for a $500 reward. Members or members family are not eligible for a reward.
